To the maximum extent permitted under Philippine law, the total liability of Hyundai Marikina and its affiliates, employees, agents, licensors, and service providers for any damages arising from the use of the Service shall be limited to the amount You have paid for the Service through the Website. If no payment was made, liability shall not exceed Five Thousand Five Hundred Philippine Pesos (PHP 5,500).

Furthermore, Hyundai Marikina does not warrant that the Service, its servers, content, communications, or emails sent from or on behalf of Hyundai Marikina are free from viruses, malware, scripts, trojan horses, worms, timebombs, or other harmful components that may disrupt Your devices or systems.

Some provisions of this Disclaimer may not be enforceable in certain jurisdictions or may be limited by applicable Philippine law or other relevant consumer protection laws. In such cases, the exclusions and limitations contained in this section shall apply to the greatest extent legally permissible.

Governing Law

These Terms and Conditions, and any dispute or claim arising out of or in connection with the Service, including its use, interpretation, or enforcement, shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law rules. You expressly agree that any legal action, claim, or proceeding arising out of or related to these Terms or your use of the Service shall be brought exclusively in the competent courts located in Metro Manila, Philippines. By using the Service, You consent to the jurisdiction and venue of such courts and waive any objection based on forum non-conveniens or similar grounds.

If it is impossible to do so, the provision shall be deemed severed from these Terms, and the remaining provisions shall continue to be valid, enforceable, and in full effect. Severability ensures that the invalidity or unenforceability of one provision does not affect the validity or enforceability of the other provisions.

Failure by Hyundai Marikina to enforce any right, provision, or term of these Terms shall not constitute a waiver of such right, provision, or term. Any waiver granted by Hyundai Marikina must be in writing and signed by an authorized representative to be valid. The waiver of any breach or failure to enforce any provision on one occasion shall not constitute a waiver of any subsequent breach or failure of the same or any other provision. You acknowledge that all rights and remedies provided under these Terms are cumulative and not exclusive of any rights or remedies provided by law.

Changes to These Terms

Hyundai Marikina reserves the right, at its sole discretion, to modify, amend, or replace these Terms and Conditions at any time. When changes are made, we will update the “Last Updated” date above to indicate the most recent revision. Material changes that may significantly affect your rights or obligations will be communicated in advance where possible, and we will use reasonable efforts to provide at least thirty (30) days’ notice before such changes become effective. What constitutes a material change shall be determined at the sole discretion of Hyundai Marikina.

By continuing to access or use the Service after any revised Terms become effective, You agree to be bound by the updated Terms.
